Money Back Guarantee Terms and Conditions

"ACT is happy to offer its subscribers in the cities of Jaipur and Pune , ACT Money Back Guarantee Scheme (hereinafter shortly referred to as the ‘Scheme’) which shall be effective from [10th July] 2024 and shall remain valid until terminated by ACT as per process established by law (‘Term’).
Under this Scheme, any subscriber, who has subscribed to a Fixed term package of ACT (i.e., ACT’s Broadband services under the Scheme for a period of 6 months or more) offered in the cities of Jaipur and Pune shall be entitled to receive 100% of their Broadband subscription charges paid by them under the Scheme, if they find the ACT’s broadband services to be non-satisfactory and choose to opt out within 29 days from the date of activation. In all such cases, where the Subscriber chooses to opt out, ACT shall refund of the Broadband subscription charges to such subscriber, subject to the terms and conditions provided below.

  1. Any Subscriber choosing to terminate the services within the first 29 days from the date of activation of the broadband services under this Scheme shall be entitled to get 100% refund of the subscription charges paid by them under the Scheme and the refund shall be processed and credited to the respective bank account of the Subscriber within 7 days.
  2. Any termination request that is received after expiry of the 29th day from the date of activation of services under this Scheme shall not be eligible for any refund under this scheme.
  3. This Scheme shall not apply to subsisting subscribers of ACT who have not subscribed their services under this Scheme in the cities of Jaipur and Pune.
  4. Any Subscriber choosing to subscribe under this Scheme shall be entitled to subscribe it only once, irrespective of whether he/she has obtained refund under this Scheme or not. Further, ACT reserves it rights to deny a subscriber enrolment under this Scheme if ACT at its sole discretion ascertains that a particular Subscriber is trying to misuse the Scheme in any manner whatsoever.
  5. This Scheme shall only apply to a subscriber who are technically feasible for ACT to provide its broadband services.
  6. Any subscriber who is seeking 100% refund of the subscription charges paid by him/her under this Scheme shall be entitled to seek such refund, only upon duly returning all the network equipment deployed by ACT at such subscriber premises for provisioning of ACT services.
  7. Only a subscriber of ACT who has enrolled himself under this Scheme as per the Customer Application Form (‘CAF’) shall be entitled to claim 100% money back refund under this Scheme and any claims seeking 100% refund of the subscription charges under this Scheme are not transferable or assignable in any manner whatsoever to any other parties.
  8. The Scheme will not apply in cases where the failure to provide Broadband Services is caused by events beyond ACT's reasonable control, such as incidents of disaster and Force Majeure.
  9. The Scheme will not apply to any subscriber who is using the broadband services for any illegal or immoral purpose.
  10. ACT reserves the right to amend these Terms and conditions at any time at its sole discretion. Any amendments will be effective immediately upon posting on ACT’s website.
  11. ACT reserves the right to partially or fully withdraw, suspend, terminate, or disconnect services to the subscriber for various reasons, including but not limited to: negative address verification, non-payment, violation of the terms of this agreement, unauthorized, illegal, or immoral use of the service, or if the subscriber's equipment or software is found to be interfering with ACT’s other services.
  12. The subscriber is governed by the terms and conditions of the Scheme as outlined herein, as well as the Customer Application Form ('CAF'), which the subscribers must sign. In the event of a conflict between the CAF and the terms and conditions indicated herein, the terms and conditions of this Scheme shall prevail to the extent of the dispute.
  13. If the subscriber breaches any of the terms and conditions stated herein, ACT may, at its sole discretion and without prejudice to any other remedy available under the law, suspend the services and terminate his entitlement under this Scheme.
  14. These Terms and Conditions shall be governed by the laws of India, and any disputes arising under this Scheme shall be submitted to the exclusive jurisdiction of Courts at Bengaluru.

ACT is merely providing connectivity to the internet and has no responsibility or control over the contents of the internet or the subscriber's usage of the same. ACT is not responsible for viruses or malicious traffic that may infect the personal computer, laptop, or mobile phone of the ACT subscriber, since ACT has no control over the same. The subscriber is solely responsible for evaluating the accuracy, completeness, and usefulness of all services, products, and other information and the quality and merchantability of all merchandise provided through the internet access service offered by ACT. The services provided by ACT are provided on an "as available" basis only. Except as otherwise agreed with the subscriber, ACT does not warrant that the services will be uninterrupted, error-free, or free from viruses or harmful components. ACT is not liable for any costs or damages that may arise directly or indirectly on account of your using the services provided by ACT, including any direct, incidental, or exemplary multiple special punitive or consequential damages in case of any force majeure. Further, ACT does not accept any responsibility or blame for any loss (notional or otherwise) that you may claim to suffer on account of any deficiency or delays in the services provided by ACT, except as otherwise agreed. ACT also hereby informs the subscriber that their personal details will be provided to the legal authorities on demand
