The Terms and Conditions (T&C) contained herein along with the Privacy Policy and Terms of Use, form an Agreement regulating our relationship with regard to the use of ACT Pvt Ltd (ACT) Products and Services by you.

Definitions

Portal/Site means the ACT platform owned and operated by ACT.

User/You means and includes any Customer / Users / You (the person or any legal entity) who uses the services offered by ACT through its Portal.

  1. Registration: Registration of the User on the Website is Mandatory. The User agrees and undertakes at all times to be responsible for maintaining the confidentiality of the password and user id, and shall be fully responsible for all activities that occur by use of such password or user id. Further, the User agrees not to use any other party's under ID and Password for any purpose whatsoever regardless of any authorization from such party.
  2. The User agrees to use the services provided by ACT, its affiliates, consultants and contracted companies, for lawful purposes only.
  3. The User agrees to provide authentic and true information. ACT reserves the right to confirm and validate the information and other details provided by the User at any point of time. If upon confirmation such User details are found not to be true (wholly or partly), ACT has the right in its sole discre tion to reject the registration and debar the User from using its services without prior intimation whatsoever.
  4. The User agrees to: (a) provide true, accurate and complete information about himself and his beneficiaries as prompted by the registration form on the Website; and (b) maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If the User provides any

      • "Customer Application Form (CAF)" shall mean the Form filled by the customer of Telecom / Internet Services as required under applicable law.

      • "MSISDN" means the Mobile Subscriber Integrated Services Digital Network Number.

      • "Product(s)" includes Site, ACT’s, applications and services.

      • "Service(s)" shall mean all Services that ACT provides to its subscribers through the Site including but not limited to Broadband Services, Digital Television Services, Over the Top Boxes, Stream TV 4K boxes, Content Streaming, entertainment and gaming services and value added services and all other Services that may be launched and provided through the Site.

      • "Site" shall mean www.actcorp.in.

      • "You" or "Your" shall mean any person accessing this website www.actcorp.in (Site), its contents or using the services offered through the Site and shall include a subscriber of Services or purchaser of Product of the Company, through the Site.

    • This Document contains the rules and regulations, terms of your access and use of the Site.

    • By accessing, browsing and / or using the Site, you confirm that you have read understood and agreed to conform to and be bound by the terms and conditions contained herein.

    • The Company may amend or update the terms contained herein by publishing such updated / amended terms of this Site, from time to time. By continuing to access and use the Site, you shall be deemed to accept and conform to the updated and amended terms.

  • Registration:

    • In order to avail any Product or Services through the Site, registration of the user on the website is mandatory. The registration process may involve without limitation, setting up of a profile, user name and password, your name and other information. You may however, browse / access certain information and post complaint, feedback or suggestion on the Site, without having to register.

    • The password is an authentication tool and we recommend that each User periodically changes the password. We strongly recommend that the password be retained confidential. You shall remain solely responsible for maintaining confidentiality of your username, password or account details which you have created for availing services through the Site. You agree to immediately notify the Company of any unauthorized use of your password or account or any other security breach.

    • Company may rely on the authority of any person accessing your account using your password.     • The Company, its affiliates or its content suppliers respect the intellectual property of others.   • No waiver for breaches:

    • If we do not act in relation to a breach of the Terms contained herein by you, that should not be construed as a waiver of any of our rights to act in relation to that breach or any later breach by you.

  • Redressal of grievance:

    • If you have any complaints or concerns with regard to content or to report any abuse of applicable laws, breach of Terms herein, or any content of the Site is in violation of your rights or the services through the Site is in violation of Rule-3 of the Information Technology (Intermediary Guidelines) Rules, 2011, then you may immediately contact the Grievance Officer in the following manner:

      • Giving a declaration-cum-undertaking along with necessary documents establishing you (i) as the rightful owner of the content to be disabled / affecting you prejudicially, (ii) as an affected person, stating that the information submitted is true, complete and accurate and no material fact has been hidden, and also stating that the Company, its affiliates, Directors, employees, including Grievance Officer shall not be liable for any loss or damage or claim for relaying on such requests;

  • Governing Law and Jurisdiction:

1. Collection of Information

In order to undertake the purposes set out in Clause 2.1, ACT may collect the following types of information:

1.1  "Personal Information" i.e., information which, either directly or indirectly, in combination with other information available or likely to be available with ACT, is capable of identifying you, which, without limitation, may include the following:

  1. Your name, father’ s name, mother’ s name, spouse’ s name, date of birth, phone number, email address, permanent address, and billing address.
  2. Photograph provided during registration or during the profile update.
  3. Proof of identity and address such as Aadhar card, PAN card, driving license, passport etc.
  4. Transactions performed which can identify you as an individual through your customer ID or other relevant unique identifier.
  5. Service specific information or identifiers such as International Mobile Subscriber Identity(IMSI), Mobile Station International Subscriber Directory Number(MSISDN), Customer ID etc.
  6. Device specific information or identifiers such as International Mobile Equipment Identity(IMEI), OS specific identifiers.
  7. The name of your device type, and original equipment manufacturer thereof;
  8. Information pertaining to your device such as Point - to - Point Protocol over Ethernet(PPPoE) username and password;
  9. Information pertaining to your Wi - Fi connection such as service set identifier(SSID) name and password;
  10. Information pertaining to the nature and identity of the applications used by you while connected to the ACT Wi - Fi;
  11. Information pertaining to the IP of the User such as IP address, IP browser user agent, browser location data received from GPS coordinator.

1.2   ACT does not knowingly collect Personal Information from any User of the Platform who is under 18 years of age.If it comes to the knowledge of ACT that ACT has inadvertently collected the Personal Information of a person below the age of 18 years, ACT agrees to take steps to delete such information.If a parent or guardian becomes aware that his or her child has provided his / her information to ACT without their consent, he or she shall contact ACT for the deletion of such information.In the event, any access or use of the Platform is made by a minor in contravention to this Policy and Terms of Use, ACT shall not be liable or responsible for any damage or injury suffered by such person.

1.3   In our cookie consent pop - up notice displayed at the time of your entry onto the Platform, the User has the free, specific, and unambiguous choice to accept the kind of cookies that ACT can collect from such User.Should you choose to withdraw or modify your consent in relation to the collection of necessary cookies, while we are in the process of providing Services, we will continue to retain and utilize the necessary Personal Information as is required by us for rendering the Services until the completion of those Services.Upon completion of the Services, we will destroy the retained Personal Information and will cease to collect any further Personal Information from you.ACT will be under no obligation to continue providing any Services to you during the period we do not collect the relevant Personal Information from you.

2.1   The information provided by you to us is used for a number of purposes connected with our business operations which may include the following:

  1. creating and providing access to the Platform;
  2. facilitating seamless access to the Products and Services;
  3. developing and improving the Products and Services;
  4. personalizing and enhancing User experience;
  5. undertaking KYC verification of the User;
  6. verify your identity, access, privileges assigned and relationship with us.
  7. provisioning of Products / Services, testing or improvement of Services, recommending various Products or Services;
  8. informing Users about new Products, Services, offers, trends, updates, and events, including order confirmations or cancellations;
  9. sending all communications on the mobile number provided by the User, even if the mobile number is registered under the do not disturb / national customer preference register list under the TRAI regulations;
  10. processing your requests, enquiries and complaints, customer services and related activities;
  11. communicating important information relating to invoices, confirmations, notices, updates, security alerts, support and administrative messages, existing or new offers, content, advertisements and promotional messages, user surveys, key policies or other administrative information;
  12. providing customer support, resolving complaints, service requests, comments and questions and providing customer service;
  13. providing periodic maintenance and support to the Products and Services, including automatic software updates;
  14. analytics and reviews for improvement of our services;
  15. enabling ACT to undertake and perform its contractual obligations;
  16. to protect, investigate, and deter fraudulent, unauthorized, infringing or illegal activity;
  17. for internal administrative purposes, as well as to manage relationship with the User;
  18. detecting, preventing and addressing technical and security issues including to combat spam, malware, malicious activities, or security risks, improve and enforce our security measures and to monitor and verify User identity so that unauthorized users do not access User accounts;
