Terms and Conditions for Valentine’s Day Contest

Terms and conditions of the Contest:

1. ACT is partnering with Netflix India to organize a Contest wherein any eligible customer can come up with creative mentions whose criteria may be as detailed in the contest page of ACT's social media platforms. ACT will select four (4) numbers of winners, who will stand chance to win the prize detailed below.
2. By participating in this contest, eligible customers/participants agree to the following Terms & Conditions, Terms of Use, Privacy Policy, and any other applicable ACT policies made available at www.actcorp.in.
3. The contest will be promoted on ACT's social media platforms and will shall be valid from 1st February 2024 to 8th February 2024. The Contest may be extended at ACT's sole discretion.
4. Eligibility Criteria:
   1. This contest is only open to ACT customers with the ACT + Netflix Plan.
   2. The Contest is only open to legal Indian residents who have attained the age of majority (i.e., completion of 18 years of age).
   3. Participants must fully comply with and follow all applicable laws, rules and regulations as may be applicable from time to time.
   4. In case ACT does not provide an ACT Netflix plan in a city where it operates, this contest shall not apply to that respective city.
   5. The Contest is not open to ACT employees, vendors, contractors, or agents.
5. Participation & Prize :
   1. Participants who satisfy the Eligibility Criteria mentioned above can participate in the Contest by visiting ACT's social media Platforms and share their slogans.
   2. The Participant(s) must ensure the genuineness and authenticity of the slogan they provide, as well as any other material, information, or data shared.
   3. The participant(s) with the most original slogan(s) will win the prize and ACT’s decision in this regard shall be final and binding. The winners in each of the cities shall be conferred with special Valentines Day Full experience setup which shall include the following:
      1. ACT and its representatives shall visit the respective customer’s residence who wins the contest, on the Valentine’s day and shall do a special curated Valentines Day decoration which may also include lights, flowers, curated cushions, Personalized gift hampers along with Snacks and beverages.
      2. ACT and its representatives shall capture the pictures of such special occasion and share the same with the respective customers and in all of its social media platforms.
6. Consent to participate in the Contest:
   1. The Participant(s) concur and consent that ACT may collect, use, process, maintain, or have access to Personal Identifiable Information (PII), which is defined as any information or set of information, whether alone or in combination with other personal information gathered, processed, used, or stored by ACT, that is sufficient to identify the participant.
   2. The Participant(s) further acknowledges that ACT may use and/or provide PII of the Participant(s) or any other individual as provided by the Participant(s) to the relevant third party(s) from time to time for the purposes of this Contest or otherwise.
   3. The Participant consents to the transfer of ownership rights to any pictures and photographs (if any) submitted to/captured by ACT for the purposes of the Contest. The Participant also recognizes and consents to the use of these photos, as well as those taken by ACT as part of this contest, for ACT's branding goals and objectives. The Participant is solely responsible for any copyright infringement or claim arising from their submission of any Photos to ACT.
   4. The Contest Winners additionally consent and permit ACT and its personnel to utilize their home and/or possessed premises for the purpose of decorating and/or setting up for an exquisite Valentine's Day. When the Contest winners offer approval for usage of their residence, they must indemnify ACT and/or its staff, including Netflix and their staffs, against theft and/or any property damage, and any claims made by the Participants in this regard will be their sole responsibility.
7. General Terms and Conditions
   1. ACT reserves the right to cancel, terminate, modify, or suspend the Contest in its sole discretion without notice to the Participants.
   2. ACT reserves the right, in its sole discretion, to disqualify any Participants who tampers or attempts to tamper with the Contest process or the operation of the Contest, or who violates these Terms & Conditions.
   3. The Participant agrees not to harm or misuse any intellectual property rights owned by ACT or any third party. Participant agrees that he or she will provide only his or her photo and not that of any third party without such third party's written consent. In the event that ACT receives any third-party claims as a result of the use of the photograph given by the Participant, the Participant agrees and undertakes to indemnify ACT against such claims.
   4. Participants agree not to share harmful, threatening, abusive, blasphemous, objectionable, defamatory, vulgar, pornographic, paedophilic, hateful, objectionable, or unlawful messages on social media platforms or pages.
   5. The Participant grants ACT consent to print and broadcast the participant's name, image, and/or images for editorial, advertisement, promotional, marketing, and/or other reasons and in any media (unless where prohibited by law).
   6. Except as provided herein ACT makes no express or implied representations or warranties, of any kind.
   7. This Contest will be governed by and construed in accordance with the laws of India. Any or all disputes arising out of this Contest shall be subject to the exclusive jurisdiction of the courts of Bangalore.
